TERMS OF CONTRACT and disclaimer
(The term "cakes" in the disclaimers also applies to cupcakes)
Your initial non-refundable retainer fee of 25%, due immediately, reserves your event date and order. This fee is non-refundable for any reason. The entire balance is due in full, 2 weeks prior to your event. The date of your final payment is the last date for any changes to the size, style, or flavors of your order. Any changes requested after this date cannot be guaranteed and may be subject to additional charges. We reserve the right to adjust pricing on orders without additional notice due to fluctuations in the pricing of ingredients and materials.
POSTPONEMENT AND CANCELLATION POLICY
We will do everything in our power to accommodate your new date in cases of postponement. However, if a new date is not selected and confirmed at least 1 month prior to your original event date, Parinda Cupcakes will assume your event has been officially canceled, and our cancellation policy will apply.
If we are unable to accommodate your new date, Parinda Cupcakes will consider your event to be canceled, and the cancellation policy will apply.
Cancellations must be made at least 30 days prior to the event date and must be in writing or by email. In the event of a cancellation, any amounts paid, minus the retainer fee, materials, ingredients purchased, and labor, may be refunded if the cancellation is made at least 30 days before the event. Cancellations made after this period will not be refunded under any circumstances.
DELIVERY
Due to the logistics of scheduling multiple deliveries and setups each day, Parinda Cupcakes requires a time range for delivery of your event cakes, as provided by you. You are responsible for confirming this time with your reception/venue staff or wedding coordinator. Cake tables must be set up and ready for us to arrive before the start of this time range. Plateaus, pedestals, risers, and dessert trays must also be in place if we are not the providers.
Deliveries to outdoor sites are scheduled as close to the event time as possible to allow for last-minute changes to the cake table location or potential risks of damage due to weather.
Please call immediately if there are any changes to the time range for delivery so Parinda Cupcakes can adjust accordingly to avoid scheduling conflicts. Contact information is provided at the top of this contract.
Delivery delays affect not only Parinda Cupcakes and its staff but also all clients awaiting their deliveries. A $25 per half-hour delay fee will be charged if setup is delayed at the venue, rounded up to the nearest half hour. The venue must be unlocked, opened, and the cake table set up by the start of the time range to avoid this penalty. The fee will be invoiced after the event.
Inflexible delivery windows (e.g., a set 2-hour window specified by you or the venue) may incur an additional fee for staffing, vehicles, and personnel. This fee applies if the setup window requires us to allocate extra resources to meet our obligations.
OUTDOOR SITE
Outdoor settings are unpredictable. While Parinda Cupcakes will do everything possible to minimize weather damage, cake and sugar will melt in temperatures above 72°F and in high humidity. Parinda Cupcakes is not responsible for damage caused by weather.
Common outdoor damage includes: sweating, condensation, running colors, sliding decorations, bug attractants, and melting buttercream, chocolate, or candy coating. We recommend keeping the cake in a cool indoor area until shortly before the reception if possible. If this is not an option, ensure a sturdy, flat cake table is set up in a shaded area, preferably under a tent or canopy. Please remember that even a tent may not protect the cake from rain blown onto the sides.
VENUE AND SITE CONDITIONS
Parinda Cupcakes reserves the right to refuse setting up a cake in any location that is not properly air-conditioned or weather-proofed, or on any cake plateau/stand that is not sturdy enough to hold the weight of our cakes. We will work with venue staff to find the best placement to ensure your cake looks beautiful when you arrive.
Cakes require a level, sturdy table and cake plateau/stand. Parinda Cupcakes is not responsible for any damage caused by tables or plateaus/stands that are unable to withstand the weight of the cake or are not properly installed.
Once cakes are set up, do not move them until they are served. Parinda Cupcakes is not responsible for damage caused by others after the cake has been set up.
Tall cocktail tables are not suitable for tiered cakes over 2 tiers. For tiered cakes of 5 tiers or more, a step stool or ladder may be required to serve and disassemble the cake.
FINALIZATION OF DESIGN
All details and number of servings for your cakes must be finalized 2 weeks before the event date.
Changes to the cake design after the execution of this agreement may result in total price adjustments.
VARIATION IN DESIGN
While Parinda Cupcakes strives to provide the exact flavors, fillings, decoration, size, color, and design discussed during consultations, cake creation is an art form and may be subject to slight variations.
Color matching is not always a precise science. The Bakery will do everything possible to match provided color swatches, but some colors may not be achievable using food-grade dyes.
Parinda Cupcakes cannot match “verbal” colors or colors sent via electronic devices, as monitors display colors differently. To attempt a color match, you must provide a color swatch 30 days in advance.
To ensure the stability and integrity of your cake, we reserve the right to make design or structural changes, both on-site and off, without prior notice.
ORNAMENTS, TOPPERS, AND FLOWERS
All ornaments and toppers should be brought to Parinda Cupcakes 7 days prior to your event to be assessed for weight, stability, and to ensure proper cake reinforcements. Parinda Cupcakes reserves the right to refuse placement of ornaments if we feel they may damage the cake or negatively affect its design.
Parinda Cupcakes or its staff are the only authorized personnel to make any modifications to the cake once it is delivered to the venue. We do not use real flowers due to potential contamination risks. Only Parinda Cupcakes staff may place or alter any flowers or other items on the cake unless prior approval is given.
The client assumes full responsibility for ensuring that all non-edible cake décor (such as sugar flowers) is removed before the cake is cut and served. While wafer paper and sugar flowers are edible, they are made with wires and should not be consumed.
If ornaments are left at the cake table unplanned, an additional charge will apply for staff labor, and an invoice will be sent after the event.
CUSTOMER PICK-UP
Parinda Cupcakes is not responsible for any damage occurring to your cake once it leaves our facility.

We recommend placing cakes on a flat, air-conditioned surface in a van or SUV, with a non-slip mat to prevent movement.
If damage occurs during transport, we may be able to repair it. The cost of repairs will depend on whether the cake is returned to the bakery or if staff is required to go on-site. Costs will be assessed and paid before repairs or service calls are made.
PHOTOGRAPHY OF YOUR CAKE
Parinda Cupcakes reserves the right to photograph your cakes and desserts before, during, and after setup for marketing, advertising, and promotional purposes without compensation to you.
ALLERGENS
While Parinda Cupcakes will attempt to reduce allergens in your cakes, we cannot prevent cross-contamination. We process common allergens such as tree nuts, peanuts, dairy, wheat, gluten, corn, and eggs. You agree to notify guests of allergen risks and hold us harmless for any allergic reactions.
NATURAL DISASTERS/ACTS OF GOD
Performance of this agreement is contingent upon Parinda Cupcakes’ ability to complete it in the event of delays or defaults caused by conditions beyond our control, including Acts of God, government restrictions, war, terrorism, insurrection, or any other cause beyond reasonable control.
REFUND POLICY
Cake flavor and texture are subjective. Refunds for flavor or texture issues after the cake has been accepted will not be honored. You may qualify for a store credit if the cake is returned and the flavor or texture does not meet our standards. Quality determination is at the sole discretion of Parinda Cupcakes. Weather and temperature variations may affect texture or design; please allow cakes to come to room temperature (3-4 hours) before serving.
PARINDA CUPCAKES, LLC. LIABILITY
Parinda Cupcakes’ liability is limited to the total cost of your cake order only. We are not responsible for any additional costs due to cancellations, dissatisfaction, or damage after the product has been delivered or picked up.
